Actually it is fine to have the version number of the Finder different than the version number of OS X. However the value of the variable
OSXversion$ should be the number returned by the operating system itself. Here is the AppleScript I use to get that value:
on getOSXversion()

-- running on Mac

local OSXversion
set OSXversion to system version of (system info)
return (OSXversion)
end getOSXversionThat looks bulletproof to me, so that that clearly places this bug . . . . . on Apple . . .
